Violation of anti-corruption legislation

The Prosecutor's Office of Glubokoe District supported the claim of the Vitebsk Regional Prosecutor's Office for the recovery from V. of income in the amount of 82 thousand rubles, obtained in violation of anti-corruption legislation.

Thus, since 2009, V. was the head of the installation and commissioning works section of OJSC "Tiraspol PMK" and, by virtue of paragraph 3 of Article 1 of the Law of the Republic of Belarus "On Combating Corruption" dated July 15, 2015 (hereinafter - the Law), belonged to the category of public officials.

According to paragraph 2 of part 1 of Article 17 of the Law, public officials are prohibited from engaging in entrepreneurial activities personally or through other persons, and from assisting their spouse, close relatives, or in-laws in engaging in entrepreneurial activities using their official position.

Contrary to the established prohibition, V. engaged in entrepreneurial activities and received income in the amount of 82 thousand rubles in 2019-2020.

In accordance with Article 40 of the Law, funds obtained in violation of anti-corruption legislation are subject to recovery into the budget.

Due to V.'s refusal to voluntarily transfer the aforementioned sum of money, the Glubokoe District Court's decision of October 28, 2021, granted the claims in full.

The court's decision has entered into legal force.
