On the clarification of legislation

The Law of the Republic of Belarus of May 26, 2021 N 112-Z "On Amendments to Codes on Criminal Liability" supplemented the Criminal Code of the Republic of Belarus (hereinafter referred to as the CC) with Articles 317-2, 341-1, 342-2.

Criminal liability under Art. 317-2 of the CC is provided for repeated driving of a vehicle by a person who does not have a driver's license.

In accordance with the note to this article, an act is recognized as committed repeatedly if such person, within one year after the imposition of an administrative penalty for driving a vehicle by a person who does not have a driver's license, provided for by Part 2 of Article 18.14 of the Code of Administrative Offenses of the Republic of Belarus, again drove a vehicle without having a driver's license.

Article 342-2 of the CC provides for criminal liability for repeated violation of the procedure for organizing or holding mass events. According to the note to this article, an act is recognized as committed repeatedly if such person has been subjected to administrative penalties twice within one year for committing administrative offenses provided for by Article 24.23 of the Code of Administrative Offenses of the Republic of Belarus (violation of the procedure for organizing or holding mass events), and within one year after the imposition of the second administrative penalty for such acts, has again violated the procedure for organizing or holding mass events.

Criminal liability under Art. 342-2 of the CC is incurred by a person who has been subjected to administrative penalties twice under Art. 24.23 of the Code of Administrative Offenses (regardless of the part of the specified article), and has violated the procedure for organizing or holding a mass event.

Similarly, issues of criminal liability under Art. 341-1 of the CC (propaganda or public demonstration, production, distribution of Nazi symbols or attributes) for repeated commission of offenses provided for by Art. 19.10 of the Code of Administrative Offenses are regulated.
