On the state of supervision over the enforcement of legislation on citizens' and legal entities' appeals, and the work of the Glubokoye District Prosecutor's Office in considering appeals

In the past year, 2024, the Verkhnyadzvinsk District Prosecutor's Office conducted 2 inspections of the enforcement of legislation on citizens' and legal entities' appeals. As a result of these inspections, 2 submissions were made to eliminate violations of the aforementioned legislation, and following their review, 12 individuals were subjected to disciplinary action. Corresponding inspections, which resulted in submissions, were carried out last year at the UP ZhKH of the Verkhnyadzvinsk District and the State Institution "Verkhnyadzvinsk District Center for Hygiene and Epidemiology." During the prosecutor's inspections, numerous instances of incomplete review of appeals, prolonged inaction on them, as well as violations of legislation regulating the procedure for handling appeals were identified.

For the 12 months of 2024, the Verkhnyadzvinsk District Prosecutor's Office received 49 appeals from citizens.

Of the received appeals, 21 were resolved directly by prosecutor's office staff, of which 9 appeals were satisfied.

Specifically, in 2024, 5 citizens' appeals concerning supervision over the legality of court decisions in civil cases (regarding filing claims in court in the interests of the appellants) were fully satisfied, as well as 4 appeals concerning supervision during pre-trial proceedings, expressing disagreement with the decisions of the Verkhnyadzvinsk District Department of Internal Affairs and the Verkhnyadzvinsk District Investigative Committee to refuse to initiate criminal proceedings.

17 received appeals during the reporting period were forwarded by the district prosecutor's office to other departments for resolution, as they contained issues within the competence of other bodies. For example, last year, 7 citizens' appeals were sent to the Verkhnyadzvinsk District Department of Internal Affairs for review, as they contained requests from the applicants to conduct investigations and hold individuals accountable for actions deemed unlawful by the appellants. 4 appeals were forwarded for consideration according to competence to the Verkhnyadzvinsk District Executive Committee, 3 of which concerned land use and land management issues.

In 2024, 11 applications were left without substantive review by the district prosecutor's office in accordance with legislative requirements. For example, a similar decision was made based on Article 15 of the Law of the Republic of Belarus "On Citizens' and Legal Entities' Applications" (hereinafter referred to as the Law) for 5 applications from citizens that did not comply with the requirements stipulated by Article 12 of the Law.

In this regard, it should be noted that in accordance with Article 12 of the Law, written applications from citizens must include: the name and (or) address of the organization or the position of the person to whom the application is addressed; the surname, given name, patronymic or initials of the citizen, the address of their place of residence (stay); a statement of the essence of the application; the personal signature of the citizen (citizens). The text of the application must be legible. Handwritten applications must be written in clear, legible handwriting. The use of obscene or offensive words or expressions in applications is not permitted. Documents confirming the authority of the applicants' representatives must be attached to written applications submitted by them.

Over 12 months of 2024, the district prosecutor's office received 28 applications from legal entities, of which 18 were reviewed. Of the 18 applications from legal entities reviewed last year, 13 contained requests for the filing of lawsuits in the interests of enterprises and organizations in the court of the Glubokoe district, as well as economic courts of the Republic of Belarus. 10 of the specified number of applications were satisfied. In addition, the district prosecutor's office reviewed 3 applications from legal entities concerning the appeal of decisions and actions of officials of the Glubokoe District Department of Internal Affairs during inspections in accordance with Article 174 of the Criminal Procedure Code.

Based on the results of the review in 2024, the district prosecutor's office took prosecutorial response measures for 10 applications from citizens and 14 legal entities: procedural decisions made by the Glubokoe District Department of Internal Affairs and the Glubokoe District Investigative Committee were canceled, and lawsuits were filed with the court.

The Glubokoe District Prosecutor's Office has organized personal reception of citizens and representatives of legal entities at a time convenient for visitors, including outside of working hours, which the district population has been informed about through the media.

In addition, personal reception by prosecutors of the district prosecutor's office is organized at the place of residence and work of citizens, as well as persons held in the correctional colony No. 13 and the temporary detention facility of the Glubokoye District Department of Internal Affairs.

For 12 months of 2024, prosecutors of the district prosecutor's office received 120 people in person.

In January of the current year, the Glubokoye District Prosecutor's Office generalized the state of supervision over the enforcement of legislation on citizens' and legal entities' appeals, and the work on considering received appeals. As a result, measures were taken to improve the effectiveness of the relevant activities in 2025. For example, a schedule for mobile personal reception of citizens at their place of residence and work has been developed, and inspections of compliance with legislation on citizens' appeals in a number of institutions and organizations of the Glubokoye district are planned.
