From January 20 to January 31, 2020, the Internal Affairs Department of the Glubokoe District will conduct preventive measures on the territory of the Glubokoe District aimed at preventing offenses and crimes related to the circulation of weapons, ammunition, explosives, and explosive devices.

From January 20 to January 31, 2020, the Internal Affairs Department of the Glubokoe District will conduct preventive measures on the territory of the Glubokoe District aimed at preventing offenses and crimes related to the circulation of weapons, ammunition, explosives, and explosive devices.

These measures are carried out on a regular basis. As a rule, violations of hunting and fishing rules ("poaching") are associated with the use of weapons, which are a source of increased danger. For illegal actions with weapons, administrative and criminal liability is provided by law. Despite this, some citizens, primarily endangering themselves, their family members, and others, keep unregistered hunting, gas, sports, and other types of weapons at their place of residence.

Administrative responsibility for offenses related to the circulation of weapons is provided for by the Code of Administrative Offenses of the Republic of Belarus:

Article 23.46. Illegal actions concerning gas, pneumatic, or projectile weapons

Illegal carrying or transportation of gas, pneumatic, or projectile weapons shall entail a fine of eight to ten basic units with or without confiscation of the object of the administrative offense.

Note. A person who voluntarily surrenders the items specified in this article and Articles 23.47 and 23.71 of this Code shall be exempted from administrative liability for acts provided for by these articles (note introduced by Law of the Republic of Belarus of July 12, 2013 N 64-Z)

Article 23.47. Illegal actions concerning cold weapons

Illegal carrying or transportation of cold weapons shall entail a fine of two to six basic units with confiscation

without confiscation of the subject of the administrative offense.

Article 23.48. Violation of the rules for handling firearms, explosives, flammable, corrosive substances or pyrotechnic articles

1. Violation of the rules for accounting, storage, use, transportation or mailing of firearms, ammunition, explosives, flammable, corrosive substances or pyrotechnic articles –

shall entail a warning or a fine of up to ten base units.

2. The same act committed repeatedly within one year after the imposition of an administrative penalty for the same offense – shall entail a fine of from ten to twenty base units with or without confiscation of the subject of the administrative offense, or deprivation of a special right with or without confiscation of the subject of the administrative offense (as amended by the Law of the Republic of Belarus of 19.07.2005 N 31-Z)

Article 23.49. Violation of the registration deadlines for firearms, gas, pneumatic or projectile weapons, renewal periods for permits for their storage and carrying, or rules for their registration

(as amended by the Law of the Republic of Belarus of 17.07.2018 N 131-Z)

Violation of the established deadlines for registration of firearms, gas, pneumatic or projectile weapons, as well as the established deadlines for renewal of permits for their storage and carrying, or rules for their registration upon change of residence – shall entail a fine of from four to fifteen base units.

Article 23.50. Evasion of the sale of firearms or ammunition

Evasion of the sale of firearms or ammunition committed by a person whose permit for their storage has been revoked –

shall entail a fine of from two to four base units.

Article 23.51. Installation of a device for silent firing or a night vision sight (sight system) on civilian or service weapons

Installation of a device for silent firing or a night vision sight (sight system) on civilian or service weapons (except for hunting sights), the use of which is established by law – (as amended by the Law of the Republic of Belarus of 12.07.2013 N 64-Z) shall entail a fine of from twenty to twentyof five basic units with confiscation of a silencer or a night vision sight (sighting system).

Article 23.71. Illegal actions concerning hunting smooth-bore firearms

(introduced by the Law of the Republic of Belarus of 17.07.2006 N 147-Z)

Illegal acquisition, transfer of possession, storage, transportation, mailing or carrying of hunting smooth-bore firearms or ammunition therefor, or illegal acquisition, transfer of possession, transportation, mailing or carrying of component parts or components of hunting smooth-bore firearms shall entail a fine ranging from ten to thirty basic units with or without confiscation of the subject of the administrative offense, or deprivation of a special right with or without confiscation of the subject of the administrative offense.

Criminal liability for illegal actions in the sphere of circulation of weapons, ammunition and explosives is provided for by Articles 294-297 of the Criminal Code of the Republic of Belarus. Article 295 of the Criminal Code of the Republic of Belarus "Illegal actions concerning firearms, ammunition and explosives" provides for punishment in the form of restriction of liberty for up to five years or imprisonment for a term of two to ten years with or without confiscation of property. However, the note to Article 295 of the Criminal Code of the Republic of Belarus states that a person who voluntarily surrenders the items specified in Articles 295-297 of the Criminal Code shall be exempted from criminal liability for actions provided for by the said articles, except for cases of sale.

We also inform weapon owners that when extending the validity period of the permit for the storage and carrying of civilian weapons, a medical certificate (of the established form) on health status must be provided. An application for extension of the permit shall be submitted one month before the expiration of its validity period and shall be considered by the internal affairs body within one month from the date of submission of the application.
