ELECTRONIC APPEALS

ATTENTION!

In connection with the entry into force from 02.01.2023 of the Law of the Republic of Belarus of 28.06.2022 No. 176-Z "On Amendments to the Law of the Republic of Belarus "On Citizens' and Legal Entities' Appeals", please pay attention to the following innovations.

From 02.01.2023, electronic appeals are understood as appeals of applicants submitted through the state unified (integrated) republican information system for accounting and processing citizens' and legal entities' appeals (hereinafter referred to as the accounting and processing system).

The accounting and processing system is an information system designed for submitting electronic appeals to state bodies and other state organizations and receiving responses (notifications) to them, as well as for processing electronic appeals, responses (notifications) to them, electronic copies of responses (notifications) to written appeals, and other information on the consideration of appeals, on leaving appeals without consideration, on the merits.

In connection with the foregoing, from 02.01.2023, if electronic mail from citizens and legal entities is received by the departments of the Investigative Committee, bypassing the accounting and processing system, such letters will not be registered and resolved as electronic appeals.

We also draw the attention of website visitors to the provisions of Article 2 of the Law of the Republic of Belarus "On Citizens' and Legal Entities' Appeals," according to which the provisions of this law do not apply to appeals that are subject to consideration in accordance with the criminal procedure legislation. Taking into account the tasks performed by the Investigative Committee in the sphere of pre-trial criminal proceedings, we inform you that the submission of applications for crimes, complaints, and petitions in criminal cases and verification materials by sending electronic appeals (including through the appeal registration and processing system) is not provided for by the norms of the Criminal Procedure Code of the Republic of Belarus (hereinafter referred to as the CPC). Such applications, complaints, and petitions, in accordance with Articles 136, 139, and 168 of the CPC, are submitted to the Investigative Committee units in writing or orally (in the latter case, with recording in the minutes).

Electronic appeals to the Investigative Committee are submitted through the state unified (integrated) republican automated system for registration and processing of citizens' and legal entities' appeals (hereinafter referred to as the appeal registration and processing system).

Electronic appeals are made in Belarusian or Russian.

Appeals must contain information about the results of their previous consideration, with attached documents (if any) confirming this information.

Electronic appeals submitted by representatives of applicants must be accompanied by electronic copies of documents confirming their authority.

If the requirements for the form and content of electronic appeals are not met, or if electronic copies of documents confirming the authority of the applicants' representatives are not attached, the electronic appeals may be left without substantive consideration.

Responses (notifications) to electronic appeals are sent through the appeal registration and processing system, except in cases where the applicant requests a written response in their electronic appeal.

The applicant has the right to withdraw their electronic appeal before its substantive consideration by submitting a corresponding written or electronic application.

An organization's response to an appeal or a decision to leave an appeal without substantive consideration after appealing to a higher authority, as well as a response to an appeal or a decision to leave an appeal without substantive consideration by an organization that does not have a higher authority, may be appealed to the court in the manner prescribed by law.

If incoming written and (or) electronic appeals of a similar nature from different applicants are of a mass character (more than ten appeals), responses to such appeals, by decision of the head of the Investigative Committee unit or a person authorized by him to sign responses to appeals in the prescribed manner, may be posted on the official website of the Investigative Committee without sending responses (notifications) to the applicants. After posting such a response (notification) on the official website of the Investigative Committee, subsequent written and (or) electronic appeals of a similar nature are not subject to consideration, and responses (notifications) to them are not sent to the applicants.

Electronic appeals from citizens must contain:

- the name and (or) address of the organization or the position and (or) surname, first name, patronymic (if any) or initials of the person to whom the appeal is addressed;

- the surname, first name, patronymic (if any) or initials of the citizen, the address of their place of residence (place of stay);

- a statement of the essence of the appeal;

- the citizen's email address.

Electronic appeals from legal entities must contain:

- the name and (or) address of the organization or the position and (or) surname, first name, patronymic (if any) or initials of the person to whom the appeal is addressed;

- the full name of the legal entity and its location;

- a statement of the essence of the appeal;

- the surname, first name, patronymic (if any) or initials of the head or the person authorized in the prescribed manner to sign appeals;

- the email address of the legal entity.
