In accordance with Articles 14, 15, and 17 of the Law of the Republic of Belarus of May 5, 1998 "On the Administrative-Territorial Structure of the Republic of Belarus", district councils of deputies, taking into account the opinions of citizens and the corresponding lower-level councils of deputies:
submit proposals to regional councils of deputies on issues of administrative-territorial structure;
form, unite, and abolish rural settlements;
establish and change the boundaries of rural settlements;
classify (in agreement with regional councils of deputies) settlements, villages, and farms as agro-towns, and agro-towns as settlements, villages, or farms;
classify settlements and villages as farms, farms as settlements or villages, settlements as villages, and villages as settlements;
establish and relocate administrative centers of village councils.
City (except Minsk city) councils of deputies, settlement councils of deputies, and rural councils of deputies, taking into account the opinions of citizens, submit proposals to higher councils of deputies on issues of administrative-territorial structure.
Citizens, in the sphere of administrative-territorial structure, have the right to:
express opinions on issues of administrative-territorial structure;
submit proposals for the formation, unification, and abolition of administrative-territorial and territorial units, the establishment and alteration of their boundaries, the establishment and relocation of administrative centers, and other issues of administrative-territorial structure to the state bodies specified in Articles 12-15 of the aforementioned Law;
participate in the consideration of issues of administrative-territorial structure that affect their rights and legitimate interests by appealing to state bodies (organizations), participating in local referendums, assemblies, and other forms of direct participation in state and public affairs, as well as through public associations in accordance with legislation;
exercise other rights provided for by legislation.
The study of citizens' opinions on these issues is carried out through public discussion.
In accordance with the Regulation on the Procedure for Conducting Public Discussions in the Field of Architectural, Urban Planning, and Construction Activities, approved by the Resolution of the Council of Ministers of the Republic of Belarus of June 1, 2011, No. 687 "On Certain Measures for the Implementation of the Law of the Republic of Belarus "On Amendments and Additions to Certain Laws of the Republic of Belarus on Issues of Architectural, Urban Planning, and Construction Activities," the procedure for conducting public discussions in the field of architectural, urban planning, and construction activities is determined. Urban planning projects, design documentation, and other documentation specified in paragraphs 19 and 23 of the said Regulation are subject to public discussion in accordance with the said Regulation.
Public discussion is conducted in the following forms:
informing natural and legal persons and analyzing public opinion;
work of the public discussion commission.
The organizer of the public discussion is the regional, district, city, town, village executive committee, the local administration of a district in a city.
In accordance with the Regulation on the Procedure for Organizing and Conducting Public Discussions of Draft Environmentally Significant Decisions, Environmental Reports on Strategic Environmental Assessment, Environmental Impact Assessment Reports, and Accounting for Adopted Environmentally Significant Decisions, approved by the Resolution of the Council of Ministers of the Republic of Belarus of June 14, 2016 No. 458 "On Approval of the Regulation on the Procedure for Organizing and Conducting Public Discussions of Draft Environmentally Significant Decisions, Environmental Reports on Strategic Environmental Assessment, Environmental Impact Assessment Reports, and Accounting for Adopted Environmentally Significant Decisions, and on Amending and Supplementing Certain Resolutions of the Council of Ministers of the Republic of Belarus", the procedure for organizing and conducting public discussions of draft environmentally significant decisions, environmental reports on strategic environmental assessment, environmental impact assessment reports is determined, with the exception of public discussions of draft concepts, programs, plans, schemes in the field of architectural, town-planning and construction activities, the procedure for which is provided for by the legislation of the Republic of Belarus on architectural, town-planning and construction activities, as well as the procedure for accounting for adopted environmentally significant decisions.
The organizers of public discussions are:
for draft program documents – the state body adopting such decisions, or an organization designated by it in the manner prescribed by law;
for draft normative legal acts – the subject of legislative initiative that prepared the draft normative legal act;
for draft decisions on issuing permits – the local executive and administrative body;
for environmental reports on strategic environmental assessment – local Councils of Deputies, local executive and administrative bodies of administrative-territorial units whose territories may be affected by the implementation of state, regional and sectoral strategies, programs, town-planning projects, jointly with the state body planning the development of state, regional and sectoral strategies, programs, town-planning projects, and with the participation of the design organization;
regarding environmental impact assessment reports – local Councils of Deputies, local executive and administrative bodies of administrative-territorial units, within the territory of which the implementation of economic and other activities is planned and whose territories are affected as a result of its implementation, jointly with the customer of the planned economic and other activities.
In accordance with the Regulation on the Procedure for Issuing Permits for the Removal of Plant World Objects and Permits for the Transplantation of Plant World Objects, approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 25, 2011 No. 1426 "On Certain Issues of Dealing with Plant World Objects," the procedure for issuing permits for the removal of plant world objects and permits for the transplantation of plant world objects is determined.
When planning the removal or transplantation of trees and shrubs in settlements, the local executive and administrative body, within 10 calendar days from the date of receipt of the conclusion from the authorized organization, ensures the conduct of public discussions on the draft decision to issue a permit for removal or a permit for transplantation in the manner established by the Council of Ministers of the Republic of Belarus.
